Practice Overview

Egerton McAfee attorneys working in the Bankruptcy and Creditors’ Rights practice group have extensive experience representing creditors in Chapter 7, Chapter 11 and Chapter 13 bankruptcy cases.  The attorneys who work in this practice group regularly assist secured creditors and unsecured creditors in pursuing their claims in Chapter 7, Chapter 11 and Chapter 13 cases, and they have a wealth of experience defending creditors from preferential transfer and fraudulent transfer claims initiated by Chapter 7 and Chapter 11 Trustees. Egerton McAfee attorneys also have many years of experience pursuing creditor claims against debtors in state and federal court proceedings as well as in arbitration proceedings.  Of course, some creditor claims can be resolved without the assistance of the court system, and Egerton McAfee attorneys routinely work with our clients to resolve their creditor claims outside of court where possible (through negotiated work outs or mediation) in order to help our clients achieve their desired goals without having to incur the additional expense of litigation.
